Curated Terms & Conditions
These Terms of Service were published on 2 June 2025 and last updated on 17 December 2025.
1. OVERVIEW AND INTRODUCTION
a. We are Curated Spaces Club Limited (hereinafter referred to as “Curated Spaces”, “we”, “our Platform” and “us”), a company registered in the United Kingdom but operating services globally.
b. We are based in London, United Kingdom. Regarding any issue related and connected to these Terms of Service and your use of Curated Spaces, we can be contacted at hello@curatedspaces.club. We have a dedicated team who will endeavour to respond to your email timeously. Please be informed that we can only give clarifications and explanations when contacted. We are not able to provide legal or technical advice.
c. We are a digital marketplace and discovery platform that allows accommodation providers (“Spaces”) and influencers/content creators (“Curators”) to collaborate, and allows individuals (“Guests”) to discover Spaces showcased on our Platform. We are not an accommodation provider, nor an influencing organisation. We do not provide accommodation, and we do not create content. We provide a platform bringing Spaces, Guests, and Curators together.
For the avoidance of doubt, Curated Spaces does not act as a booking agent, travel agent, or payment processor, and does not process bookings or take guest payments. Where a Guest wishes to book a Space, the Guest is directed to the Space’s own booking system to complete their reservation directly with the Space. Any booking contract is formed solely between the Guest and the Space and is subject to the Space’s terms and policies.
d. By using our Platform and our Services, Users agree to be bound by these Terms of Service, our Privacy and Cookies Policy, and all our legal policies as contained on our Platform, to the extent to which they apply to your use of our Services. Before any term becomes binding on you, we shall give you notification of such terms. These terms are incorporated by reference.
e. These Terms of Service govern and regulate your use of our Platform and Services. By using our Platform and our Services, you consent to these terms and are bound by them. Please kindly read these terms carefully. These Terms override any previous communication or agreement with Curated Spaces in relation to any of our Services and our Platform.
2. DEFINITIONS.
As used in these Terms of Service, the following shall have the meanings ascribed to them below, with words in the singular deemed to include those in the plural and vice versa:
Account or Dashboard – means a page where registered Users can view their activities, manage their membership, manage their activity on the Platform (including Listings and Collaborations), and edit their settings.
Booking – means a reservation made directly between a Guest and a Space using the Space’s own booking system. Curated Spaces is not a party to any Booking contract.
Commission – means Curator Commission only, unless otherwise expressly agreed in writing. The use of “Commission” shall be interpreted in context with the subsection to which it appears.
Collaboration – means any engagement between a Space and a Curator for the purpose of promoting Spaces’ accommodations and listings. A Collaboration may involve a complimentary stay, discounted stay, or paid deliverables, subject to the terms agreed between the Curator and the Space.
Curated Spaces – means Curated Spaces Club Limited, a company registered and located in the United Kingdom, which can be contacted at hello@curatedspaces.club.
Curator(s) – means influencers, content creators, and social media personalities referred to as Curators on our Platform, and who collaborate with Spaces through our Platform to promote accommodations via social media, photography, video content, or editorial features.
Curator Commission – means any commission payable to a Curator in connection with referrals or bookings attributed to that Curator through Curated’s tracking tools, as described in clause 8 and/or displayed in the Curator’s Dashboard, as may be updated from time to time.
Force Majeure Event – means any circumstance beyond the reasonable control of either party that prevents or delays the performance of their obligations under this Agreement. Such events may include, but are not limited to, natural disasters (such as earthquakes, floods, hurricanes, or wildfires), acts of war, terrorism, civil unrest, governmental actions or restrictions (including travel bans, lockdowns, or new regulations), and public health emergencies such as epidemics or pandemics.
Guest – means an individual who makes a Booking directly with a Space after discovering the Space via our Platform.
Guest Services – means the services described in clause 7.
Listing – means the description of a room, apartment, house, or property that is made available on our Platform by Spaces for discovery and promotion purposes.
Listing Fee – means a fixed annual fee (or other periodic fee) payable by a Space to Curated Spaces for inclusion on the Platform and access to relevant tools, features, and services, as agreed in writing between Curated Spaces and the Space and displayed in the Space’s Dashboard.
Payment Provider – means any third-party provider used by a Space (or a User) to process payments or bookings. Curated Spaces does not receive, hold, or remit Guest payments for Bookings.
Platform – means the technology operated by Curated Spaces on www.curatedspaces.club, including all associated domains and subdomains, mobile applications, and digital services.
Services – means the services provided by Curated Spaces through the Platform, including the facilitation of Listings, referral tools, Collaborations, and the use of the Dashboard.
Spaces – means property owners, boutique accommodation providers, and other lodging operators that list accommodations on the Platform and agree to allow Guests to discover their accommodation and to collaborate with Curators.
Terms – means these Terms of Service as amended from time to time.
User – means any person who visits, uses or registers on the Platform including Spaces, Guests and Curators.
We, us, our or Curated – means Curated Spaces Club Limited.
You, your – means you as a User of our Services and our Platform.
3. CREATING AN ACCOUNT
a. To access and use some parts of our Services, you will be required to register and create an Account on our Platform. To create an Account, you must be at least 16 years of age. You may create an Account as an individual, on behalf of a company or other legal entity. You represent and warrant that: (a) all registration information you submit will be true, accurate, current, and complete; (b) you will maintain the accuracy of such information and promptly update such registration information as necessary; (c) you have the legal capacity and you agree to comply with these Terms of Service.
b. If you are using the Services on behalf of a legal entity (such as your employer), you represent and warrant that you have the authority to bind that entity to these Terms and you agree to be bound by these Terms on behalf of that entity.
c. You are responsible for maintaining the confidentiality of your Account login information and for all activities that occur under your Account. You agree to immediately notify Curated of any unauthorized use or suspected unauthorized use of your Account. Curated will not be liable for any loss or damage arising from your failure to comply with this requirement.
d. You may not create more than one Account without express permission from us. You may not assign or otherwise transfer your Account to another party without our prior written consent.
e. Curated reserves the right to suspend or terminate your Account or access to our Platform if we suspect that you have provided inaccurate information, misrepresented your identity, or engaged in any fraudulent or unlawful activity.
f. We may refuse to allow any individual or entity to register for an Account or use our Services for any reason, at our sole discretion.
4. USE OF OUR PLATFORM
a. Our Platform is designed to facilitate discovery of Spaces by Guests and Collaborations between Curators and Spaces, and to provide referral tools that may attribute bookings made directly with Spaces to Curators. Our Platform may be used to browse Listings, create and manage a User profile, communicate with other Users, and enter into agreements for Collaborations.
b. You agree not to use our Platform for any illegal, fraudulent, or harmful purpose, or to engage in conduct that may damage our reputation or interfere with the proper operation of the Platform.
c. You agree not to:
i. use the Platform to harm, threaten, or harass another person, organization, or Curated;
ii. use the Platform to impersonate or misrepresent your affiliation with any person or entity;
iii. attempt to gain unauthorized access to the Platform or any networks or systems connected to it;
iv. interfere with the operation of the Platform, or disrupt or compromise the security of the Platform or any system or network used by Curated;
v. use automated scripts or scraping tools to collect data from the Platform without our prior written consent;
vi. upload or transmit viruses, malware, or other malicious code;
vii. use the Platform to send unsolicited messages or spam;
viii. violate any applicable law or regulation.
d. Curated may, at its sole discretion and without notice, remove any content or suspend or terminate any Account that violates these Terms or that we consider to be inappropriate, harmful, or otherwise inconsistent with the values and purpose of our Platform.
e. We do not guarantee that the Platform will be error-free or uninterrupted. We may suspend or discontinue the Platform or any part of it at any time, with or without notice.
f. You acknowledge that your use of the Platform is at your own risk and that Curated disclaims all liability arising from your use of the Platform, to the fullest extent permitted by applicable law.
g. We may from time to time develop and provide updates to the Platform, which may include upgrades, bug fixes, patches, and other error corrections and/or new features. Updates may also modify or delete certain features and functionality. You agree that we have no obligation to provide any updates or to continue to provide or enable any particular features or functionality.
5. CURATORS’ TERMS
a. To use the Services as a Curator, you must first apply and be approved by Curated. We reserve the right to accept or reject any application at our sole discretion.
b. Once approved, Curators may use the Platform to participate in Collaborations with Spaces. Curators agree to provide accurate and complete information in their profiles and to update this information as necessary.
c. Curators are responsible for ensuring that any content they create as part of a Collaboration complies with applicable advertising and consumer protection laws, including but not limited to disclosing paid partnerships and affiliate relationships in accordance with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code), the UK Competition and Markets Authority (CMA) guidelines, and relevant ASA (Advertising Standards Authority) requirements.
d. Curators must not engage in fraudulent activity or misrepresent their reach, audience, or engagement metrics. Curated reserves the right to audit or request verification of any such metrics.
e. Curated may offer Curators the opportunity to earn commission, fees, or other incentives for successful referrals, Collaborations, or activity on the Platform. Any such incentives will be set out in a separate agreement or specified within the Platform and/or displayed in the Curator’s Dashboard.
f. Curators understand that participation in Collaborations is not guaranteed and that all Collaborations are subject to availability and approval by both Curated and the relevant Space.
g. Curators agree to act professionally and respectfully in all dealings with Curated, Spaces, and other users of the Platform.
h. Curated reserves the right to suspend or remove any Curator from the Platform for violations of these Terms or any behaviour deemed unprofessional or detrimental to the Curated community.
6. SPACES’ TERMS
a. Spaces may use the Platform to discover and collaborate with approved Curators for the promotion of their accommodation, events, and experiences.
b. Spaces agree to provide accurate and up-to-date information about their properties and offerings, including availability, pricing, and any terms or conditions that apply to Bookings (made directly with the Space) or Collaborations.
c. Spaces are responsible for ensuring that their Collaborations comply with applicable advertising and consumer protection laws, including clearly disclosing any paid or incentivised partnerships with Curators in accordance with CMA and ASA guidance.
d. Spaces agree to treat Curators professionally and respectfully and to honour any agreed terms for Collaborations, including timely payment of any agreed fees.
e. Spaces understand that inclusion in the Platform does not guarantee participation in any Collaboration or Booking and that all arrangements are subject to availability and mutual agreement with Curators.
f. Curated reserves the right to suspend or remove any Space from the Platform for violations of these Terms or any conduct deemed unprofessional or detrimental to the Curated community.
g. Listing Fee and commercial terms. Spaces agree to pay the Listing Fee applicable to their account. The Listing Fee, contract term, renewal date, and any applicable discounts will be agreed in writing and displayed in the Space’s Dashboard or onboarding documentation.
h. Renewals. We will contact Spaces approximately two (2) months before the end of the then-current contract term. Unless a Space provides written notice of cancellation at least thirty (30) days before the contract end date, the contract will automatically renew for a further term on the same basis, unless we notify the Space of updated commercial terms in advance.
7. BOOKINGS
a. Curated enables Guests to discover Spaces and directs Guests to the Space’s own booking system to complete reservations directly with the Space. Curated does not process bookings or take guest payments, and is not a party to any booking contract.
b. Any Booking contract is solely between the Guest and the Space. Spaces are solely responsible for honouring Bookings, including providing the accommodation or experience as described, handling cancellations or refunds in accordance with their stated policies, and complying with any applicable local regulations or licensing requirements.
c. Guests are responsible for reading and understanding the Space’s terms before completing a Booking. Curated is not liable for disputes arising from a Booking, but may, at its discretion, assist in facilitating communication between the Guest and the Space.
d. Curated does not process payments for Bookings and does not store full payment information for Bookings.
e. Curated reserves the right to restrict access to the Platform or remove Listings in cases of suspected fraud, abuse, or violation of these Terms.
8. COMMISSIONS & FEES
a. Curated may receive Listing Fees, referral fees, or other forms of compensation from Spaces in connection with access to and use of the Platform, and may receive compensation from third parties in connection with platform partnerships. These are determined by each Space’s individual arrangement with Curated. Where applicable, the commission amount will be agreed in writing and displayed in the Space’s Dashboard or onboarding documentation.
b. Curators may be eligible to receive commission or other fees for referrals or bookings attributed to their activity using Curated’s tracking tools. The applicable terms (including attribution method, calculation basis, payout timing, thresholds, and verification) will be set out in a separate agreement or clearly communicated by Curated within the Platform and/or displayed in the Curator’s Dashboard.
c. Payments to Curators may be subject to verification processes and may be processed through third-party payment providers. Curated does not guarantee timely payment in cases where a Space or a third party fails to report, validate, or honour a Booking or Collaboration.
d. Curated reserves the right to withhold or adjust Curator commission payments in cases of suspected fraud, misuse, policy breach, or error.
e. Any disputes regarding Curator commission or payments must be raised within 30 days of the relevant activity or event. Curated will review such disputes in good faith but is not obligated to make retroactive payments unless required by law.
9. INTELLECTUAL PROPERTY
a. Curated retains all rights, title, and interest in and to the Platform, including all content, trademarks, branding, and underlying technology, except for content uploaded by Users.
b. Users grant us a non-exclusive, royalty-free, worldwide license to host, use, distribute, display, and promote any content you submit to the Platform (“Your Content”) — but only for the purpose of operating, marketing, and improving the Platform or other Curated services, and only for as long as your account remains active.
c. Users represent and warrant that they have all necessary rights to upload and share any content they submit to the Platform and that such content does not infringe any third-party rights or violate any laws.
d. Curated may remove or disable access to any content that it believes, in its sole discretion, violates these Terms, applicable laws, or third-party rights.
10. USER CONDUCT
a. Users agree to use the Platform in a lawful, respectful, and responsible manner and not to:
i. Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations;
ii. Infringe the rights of others, including intellectual property, privacy, or contractual rights;
iii. Upload or share any false, misleading, defamatory, or offensive content;
iv. Interfere with or disrupt the integrity or performance of the Platform;
v. Attempt to gain unauthorised access to any part of the Platform or related systems;
vi. Impersonate any person or entity, or misrepresent their affiliation with any person or entity.
b. Curated may, at its sole discretion, suspend, restrict, or terminate access to the Platform by any User who violates these Terms, without prior notice and without liability.
c. Users are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account.
11. FEES AND PAYMENTS
a. Some features of the Platform may require payment, either by Spaces or Curators. Fees and payment terms will be disclosed prior to purchase or use.
b. Curated may charge Spaces fees for access to Platform features, visibility enhancements, inclusion on the Platform, and related services. These fees may be charged as one-time payments, subscriptions, or annual Listing Fees, as agreed in writing and displayed in the Space’s Dashboard.
c. Curated may charge Curators for access to premium tools, campaign services, or other features.
d. All fees are exclusive of applicable taxes unless otherwise stated. Users are responsible for paying any taxes associated with their use of the Platform or receipt of services.
e. Payments made to Curated (including Listing Fees) are non-refundable unless otherwise specified or required by law. If Curated terminates a User’s account for breach of these Terms, the User will not be entitled to any refund.
f. Curated uses third-party payment processors to facilitate payments made to Curated and/or payouts to Users where applicable. Users may be required to agree to separate terms with such processors and are responsible for ensuring the accuracy of their payment information.
12. TAXES AND REPORTING
a. Curators are solely responsible for determining any tax obligations that may arise from their use of the Platform, including income earned through Collaborations, Campaigns, or Bookings.
b. Curated may provide Curators with tools to track earnings and generate tax documentation, but Curated does not provide legal or tax advice.
c. Curated may be required to collect and remit taxes on certain transactions, depending on jurisdiction. Users agree to provide Curated with accurate and timely information necessary to comply with tax obligations.
d. Where required by law, Curated may report payments made to Curators to tax authorities and may withhold applicable taxes.
13. LICENSES AND INTELLECTUAL PROPERTY (UPDATED TO INCLUDE CONTENT USAGE RULE)
a. Platform Content. All content made available by Curated through the Platform, including but not limited to software, designs, text, graphics, images, videos, and logos (collectively, “Platform Content”), is the property of Curated or its licensors and is protected by intellectual property laws. Users may not reproduce, distribute, modify, or create derivative works of Platform Content without Curated’s prior written consent.
b. User Content. Users grant us a non-exclusive, royalty-free, worldwide license to host, use, distribute, display, and promote any content you submit to the Platform (“Your Content”)—but only for the purpose of operating, marketing, and improving the Platform or other Curated services, and only for as long as your account remains active.
c. Spaces and Curators are responsible for ensuring they have the necessary rights and permissions to share User Content through the Platform, including securing model or property releases where required.
d. Feedback. If a User provides suggestions, comments, or other feedback to Curated regarding the Platform (“Feedback”), Curated may use and incorporate such Feedback without restriction or obligation to the User.
e. Creator Content usage by Spaces. Content created by a Curator remains the Curator’s intellectual property unless otherwise agreed in writing. A Space may only reuse Curator content for organic purposes where the Space’s commercial plan includes content usage rights (as displayed in the Space’s Dashboard or agreed in writing), and such usage is limited to up to five (5) images per Collaboration and must include appropriate credit. Any paid advertising, website use, email marketing, press usage, or other commercial use requires a separate licence agreed with the Curator (and/or Curated where applicable).
14. DMCA AND COPYRIGHT INFRINGEMENT
a. Curated respects the intellectual property rights of others and expects Users to do the same. If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please notify us pursuant to the Digital Millennium Copyright Act ("DMCA").
b. Your notice must include:
i. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
ii. A description of the copyrighted work that you claim has been infringed;
iii. A description of where the material you claim is infringing is located on the Platform;
iv. Your address, telephone number, and email address;
v. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
vi. A statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

15. THIRD-PARTY SERVICES AND LINKS
a. The Platform may contain links to third-party websites or services that are not owned or controlled by Curated. Curated does not endorse or assume any responsibility for such third-party services.
b. Your interactions with third-party services are solely between you and the third party. We encourage you to read the terms and privacy policies of any third-party services you engage with through the Platform.
c. Curated is not liable for any loss or damage incurred as a result of your use of third-party websites or services.
16. TERMINATION
a. Curated may suspend or terminate your access to the Platform, including any account you may have, at any time, for any reason or no reason, including if we believe you have violated these Terms or any applicable law.
b. Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
c. You may terminate your account at any time by following the instructions in your account settings or by contacting us at hello@curatedspaces.club. Termination will not relieve you of any obligation to pay fees accrued prior to termination.
17. DISCLAIMERS
a. The Platform and all content, products, and services provided through it are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
b. Curated does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
c. We make no guarantees regarding the availability, performance, or reliability of the Platform or any content or services provided through the Platform.
18. LIMITATION OF LIABILITY
a. To the fullest extent permitted by applicable law, Curated and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
i. your access to or use of or inability to access or use the Platform;
ii. any conduct or content of any third party on the Platform;
iii. any content obtained from the Platform; and
iv. unauthorized access, use, or alteration of your transmissions or content.
b. In no event shall Curated’s total liability to you for all claims relating to the Platform exceed one hundred pounds (£100).
19. INDEMNITY
You agree to indemnify, defend, and hold harmless Curated and its affiliates, officers, agents, employees, and partners from and against any claim, liability, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
a. your access to or use of the Platform;
b. your User Content;
c. your violation of these Terms; or
d. your violation of any rights of another, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.
20. GOVERNING LAW AND JURISDICTION
These Terms and any action related thereto will be governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
21. GENERAL TERMS
a. Entire Agreement. These Terms constitute the entire and exclusive understanding and agreement between Curated and you regarding the Platform and supersede and replace any and all prior oral or written understandings or agreements between Curated and you regarding the Platform.
b. Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without prior written consent from Curated. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. Curated may freely assign or transfer these Terms without restriction.
c. No Waiver. The failure of Curated to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
d. Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
e. Force Majeure. Curated shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor or materials.
f. Relationship of the Parties. Nothing in these Terms shall be construed to create a partnership, joint venture or agency relationship between you and Curated.
g. Notices. Any notices or other communications provided by Curated under these Terms, including those regarding modifications to these Terms, will be given by posting to the Platform or via email.
h. Feedback. We welcome feedback, comments and suggestions for improvements to the Platform. You can submit Feedback by emailing us at hello@curatedspaces.club. You grant to us a non-exclusive, worldwide, perpetual, irrevocable, fully paid, royalty-free, sublicensable and transferable license under any and all intellectual property rights that you own or control to use, copy

23. ADDITIONAL TERMS MAY APPLY
Depending on how you interact with the Platform, additional terms may apply to you, such as our Creator Terms of Service, Partner Terms, Community Guidelines, or other guidelines and policies. If there is a conflict between these Terms and the additional terms that apply to you, the additional terms will govern with respect to the specific service or feature to which they apply.
